DWD Resources for Employers

The Indiana Department of Workforce Development (DWD) has recevied an unprecedented number of claimants during the pandemic. The DWD needs employers to review the below resources to understand the correct ways to report claimant info to the Department:


Details about the Notice of Work Recall Refusal (Employer version):

  • Use this new Form 640-WR during the pandemic to report an employee has refused to return to work after a layoff when recalled.
  • Previously, work recall refusals were reported using the 640-P.
    • Employers may still use this form; however, the new form requests additional info that allows the DWD to process work recall refusals quicker.
  • Employers using SIDES can report a refusal to return to work online.
    • Access the Separation Information exchange, open the claim, choose “Not Listed Above” as the employer’s reason for separation, and attach the document to the response. 
  • When DWD receives a 640-WR, DWD will put a hold on future UI payments to the employee while they investigate the issue.


Details about the Unemployment Insurance Protest (Employer version):

  • Use this Form 640-P when not participating in SIDES to protest an employee claiming benefits.
  • This could include a claimant who appears on your benefit charging statement, but has never actually worked for you.
  • Provide the following info regarding the separation of the employee on this form, including:
    • Voluntary Quit
    • Gross Misconduct
    • Failed/Refused Drug Test
    • Still Employed
    • Discharge for Cause
    • Failed Pre-Employment Drug Test
    • Availability
    • Employment Status
    • School Worker
    • Employee Receiving Deductible Income After Separation (pension, vacation/sick pay, etc.)
    • NOTE: Work Refusal is also listed, but use the 640-WR during COVID-19.


Details about the New Hire Reporting:

  • Indiana Statute and the Personal Responsibility and Work Opportunity Reconciliation Act require all employers to report newly hired and re-hired employees to a state directory within 20 days of their hire date, including:
    • Individuals who haven't been previously employed by you; and
    • Individuals you previously employed, but have been separated for at least 60 consecutive days.
  • Fraud Reporting:
    • If you believe an employee isn't entitled to benefits, the best method to report this info is via a protest statement on either the 640-WR or 640-P forms. 
    • If after the DWD reviews the info provided and finds the individual may have obtained benefits fraudulently, the case will be forwarded to the fraud investigator for review.
    • You may use the fraud reporting website to submit tips on others (non-employees) you know or believe to be fraudulently obtaining benefits.
